Agreement to These Terms

These Terms of Service govern your access to and use of the Who Fumbled Me™ Shopify store, website content, digital products, podcast pages, forms, and related services. By using the store or placing an order, you agree to these terms and the posted Privacy Policy, Refund Policy, and Digital Download Policy. If you do not agree, do not use the services.

Eligibility and Accurate Information

You must be legally able to enter a binding agreement in your jurisdiction. You agree to provide accurate checkout and contact information and to use the store only for lawful personal purposes.

Digital Products and Delivery

Who Fumbled Me?™ playbooks are digital products delivered electronically. After completing an eligible purchase, customers will receive access to their purchased playbook through the digital-delivery method provided at checkout and/or by email. Customers are responsible for providing a valid email address, maintaining access to that email account, and using a compatible device and software to access the digital files.

Personal License

Unless otherwise stated in writing, each purchase grants one limited, revocable, non-exclusive, non-transferable license to use the digital product for personal purposes. You may not share, reproduce for others, distribute, upload, sell, sublicense, modify for resale, or use the content to create a competing product or service.

Orders, Pricing, and Payment

Prices, taxes, and available payment methods will be shown at checkout. We may correct errors, reject or cancel orders affected by suspected fraud, technical issues, or inaccurate pricing, and limit purchases when reasonably necessary. If we cancel a paid order, the amount charged for the canceled item will be refunded as required.

Refunds

Refund eligibility is governed by the posted Refund Policy and any non-waivable rights under applicable law. Review the product description, format, and requirements before purchase.

Educational Purpose and No Professional Advice

The playbooks, podcast, coaching language, and related content are educational and personal-development resources. They are not medical, mental-health, legal, financial, or crisis advice and do not create a therapist-client, attorney-client, financial-adviser, or other professional relationship. If a relationship involves abuse, coercion, threats, stalking, or immediate danger, seek qualified local support rather than using couple exercises to negotiate safety.

Intellectual Property

The Who Fumbled Me™ name, Playbook Collection, Franchise Manual™, Coach Mya and Coach Marcus content, logos, graphics, playbook text, worksheets, audio, video, and site content are owned by or licensed to Who Fumbled Me LLC and protected by intellectual-property laws. No rights are granted except the personal license expressly described above.

Acceptable Use

You may not interfere with store security; use automated tools to scrape or copy content without permission; upload malicious code; impersonate another person; attempt unauthorized access; infringe intellectual-property or privacy rights; harass others; or use the services for unlawful, deceptive, or abusive conduct.

Third-Party Services and Links

The store may use or link to Shopify, payment processors, digital-delivery providers, podcast platforms, social networks, and other third-party services. Their terms and privacy practices apply to their services. We are not responsible for third-party platforms outside our reasonable control.

Disclaimer of Warranties

To the fullest extent permitted by law, the services and digital products are provided “as is” and “as available.” We do not guarantee any particular personal, dating, relationship, financial, or other outcome. Nothing in these terms excludes warranties or rights that cannot legally be excluded.

Limitation of Liability

To the fullest extent permitted by applicable law, Who Fumbled Me LLC and its owners, officers, employees, affiliates, contractors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of the site, products, services, digital content, or inability to access them.

To the fullest extent permitted by applicable law, our total liability for any claim arising from or related to a purchase will not exceed the amount you paid to us for the product or service giving rise to the claim.

Nothing in these Terms excludes or limits any liability or consumer rights that cannot lawfully be excluded or limited under applicable law.

Indemnification

To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Who Fumbled Me LLC, Who Fumbled Me?™, and their owners, officers, employees, affiliates, contractors, and service providers from and against claims, liabilities, damages, losses, and reasonable costs and expenses arising out of or related to your material violation of these Terms, misuse of the site or products, infringement of another person’s rights, or unlawful conduct.

Nothing in this section requires you to indemnify any party for conduct for which indemnification cannot lawfully be required.

Suspension and Termination

We may suspend or terminate access when reasonably necessary to protect the store, customers, intellectual property, or legal rights, or when these terms are materially violated.

Governing Law and Disputes

These Terms and any dispute arising out of or relating to these Terms, the site, or our products and services will be governed by the laws of the State of California, United States, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Any dispute will be handled in accordance with applicable law and any dispute-resolution procedures expressly agreed to between you and Who Fumbled Me LLC. Nothing in these Terms limits any rights or remedies that cannot lawfully be waived under applicable consumer protection laws.

Changes to These Terms

We may update these terms for operational, legal, or service changes. The revised date will appear at the top. Material changes will be communicated when required by law.
